Case of September 12 coup dropped based on statute of limitation

Ankara Chief Prosecutor’s Office has decided to order a ‘lack of ground for legal action’ on the case against September 12 military coup, in which those responsible for the act had been charged with ‘attempt to annihilate the Constitutional order’.

In its decision, the Chief Prosecutor indicated that then Chief of General Staff and the 7th President Kenan Evren, along with then General of Air Forces Tahsin Şahinkaya, had been sentenced to ‘aggrevated life imprisonment’; however, since both Evren and Şahinkaya passed away while Yargıtay’s (Court of Cassation) 16th Criminal Divison was examining the appealed case, it has been ordered to be annulled also based on the ‘statute of limitations’ since over three decades have passed over it.

The decision of the Chief Prosecutor’s Office also included the conclusion that ‘since most of the other suspects - who was filed a criminal complaint against in relation to the September 12 coup - also passed away, there was no ground for prosecution.’

According to the further explanations in the text of the decision, about 1610 victims or complainants – including politicians – were included in scope of the investigations and the suspects had been charged with ‘attempting to annihilate Constitutional order’; ‘attempting to abolish the Grand National Assembly or its ability to function’; ‘attempting to kill purposefully’; ‘torturing’; ‘interfering with people’s freedoms’; ‘assaulting’; ‘threatening’; ‘inflicting wounds on purpose’; and, ‘sexual assault.’
